Terms of Service
These terms are the agreement between you and us when you use Abuna to sell subscriptions. Please read them before you create an account.
1. Who we are
Abuna is run by Desgn Space, a company whose registration in Cameroon is in progress. In these terms, “we” and “us” mean Desgn Space. “You” means the business or person who creates an Abuna account, and everyone you invite to your team.
Your customers are the people who subscribe to what you sell. They buy from you, not from us. Their agreement is with you.
2. What Abuna does
Abuna lets you sell subscriptions without building billing. With it you can:
- create products and prices, with a hosted checkout page for each price;
- send each customer a pay link every period, by email and, if they connect it, by Telegram;
- give each customer a private portal to see their plan, pay what is due, or cancel;
- receive signed webhooks on your server when something happens, such as a payment.
Abuna has two modes. Test mode has its own data and keys, and never charges anyone. Live mode charges real customers.
3. Your account
- You must be at least 18 and able to enter into contracts for the business you sign up for.
- Give us accurate details and keep them up to date.
- Keep your password and secret keys safe. Anyone who has them can act as you. Tell us right away if you think someone else has them.
- You are responsible for what happens in your account, including what your team members do.
4. Payments
In Live mode, customer payments are processed by a licensed payment provider. When and how you receive your money is set by its terms, which you accept before you go live. Abuna is not a bank, and does not lend money or offer credit.
We show each payment’s status as the payment provider reports it. If a payment fails or is reversed, the invoice stays unpaid until the customer pays again.
5. Fees and taxes
You pay the fees shown in your dashboard before you switch to Live mode. We will tell you by email at least 30 days before we change a fee. Test mode is free.
You are responsible for the taxes on what you sell, including VAT, and for issuing any tax documents your customers are owed.
6. Your duties to your customers
You sell to your customers, so you are responsible for:
- what you sell, its price, and delivering it as promised;
- your own terms, refund policy, and customer support;
- following the consumer protection laws that apply to you, including Cameroon’s Framework Law No. 2011/012 on consumer protection;
- having the right to share your customers’ details with us, and telling them in your privacy notice that Abuna handles billing for you.
7. What you may not do
Don’t use Abuna to:
- sell anything illegal where you or your customers are;
- deceive customers, or charge them for anything they did not agree to;
- launder money, finance terrorism, or get around sanctions;
- send messages your customers did not ask for, by email or Telegram;
- break, overload, or probe our systems, or access data that isn’t yours;
- resell or share access to Abuna, or copy it to build a competing service.
8. Your data and your customers’ data
You own the data you and your customers put into Abuna. You let us use it only to run, secure, and improve the service, and to meet our legal duties.
For your customers’ details, we act on your instructions, as your processor. Our Privacy Policy explains what we collect, who helps us process it, how long we keep it, and the rights people have under Cameroon’s Law No. 2024/017 on personal data protection.
9. Availability and changes to the service
We work to keep Abuna running and your data safe, but we can’t promise it will never be down. We may pause it for maintenance, and we tell you ahead of planned work when we can. We may add, change, or remove features. If a change takes away something you rely on, we tell you at least 30 days before.
10. Suspending or closing an account
You can close your account at any time by writing to us.
We may suspend or close your account if you break these terms, if your use puts customers or Abuna at risk, or if the law requires it. We tell you why first, unless the risk is urgent or the law forbids it. If we close your account for no fault of yours, we refund any fees you paid for time you can no longer use.
After an account closes, we delete or keep its data as our Privacy Policy says.
11. Our intellectual property
Abuna’s software, name, and design belong to us. These terms let you use them only to run your business on Abuna. If you send us ideas or feedback, we may use them without owing you anything.
12. Liability
We provide Abuna as it is. We are not liable for indirect losses, such as lost profits or lost customers. Our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim.
Nothing in these terms limits liability that the law does not allow us to limit, such as for fraud or gross negligence.
You are responsible for claims your customers bring about what you sell to them, and you cover our costs if such a claim is brought against us.
13. Changes to these terms
If we change these terms in a way that matters to you, we email you at least 30 days before the change takes effect. If you keep using Abuna after that, the new terms apply. If you don’t agree, you can close your account before then.
14. Law and disputes
These terms are governed by the law of Cameroon, including the OHADA Uniform Acts that apply. If we disagree, we will first try to settle it together within 30 days of one of us writing to the other. If we can’t, the courts of the place of our registered office will decide.
